     The purpose of bankruptcy is to give a person a chance to escape

severe debt problems. If your debts have been discharged in bankruptcy

at some point in your life, there is no guarantee that you will not run into

serious financial problems at another point in your life. You may be

wondering whether or not you can file for bankruptcy again.

     While there are no limits to the number of times you can file bankruptcy, there are limits to the number of times your debts can be discharged. The discharge is the most important part of a bankruptcy, as once your debts are discharged, your creditors can no longer take any action against you to collect on the debts. The limits on the number of times you can receive a discharge are as follows:

  • If you have discharged your debts in a Chapter 7 filing, you must wait eight years before you can receive another Chapter 7 discharge. You only need to wait four years before you can obtain a discharge of your debts under Chapter 13.

  • If you have discharged your debts in a Chapter 13 filing, you must wait two years before you can receive another discharge under Chapter 13. You must wait six years before you can get a discharge under Chapter 7.
